What Type of Settlements are available?
Temporary Total Disability Benefits (TTD) This
type of benefit is paid on a weekly basis to injured workes who are
unable to return to work for any type of work after an on the job
injury has occurred. These benefits pay the employee two-thirds of the
worker's average weekly wage, up to a limit of $500. Workers with
serious injuries receive benefits for an unlimited time period.
Temporary Partial Disability Benefits (TPD)
This is a benefit paid weekly to workers who return to work on a job
paying less as a result of the on job accident. This benefit plan is
calculated on two-thirds of the difference between the employee's
average weekly wage before and after the injury, up to a certain
limit. Benefits are paid for up to 350 weeks.
Permanent Partial Disability (PPD)
This benefit is paid weekly to workers whos on the job injury results
in an injury that causes a permanent disability. Doctors use AMA
guidelines to determine the percentage of disability and payment is
based on the following formula; the percent of disability x the number
of weeks the State Workers' Comensation Board assigns to this percent
of disability x the Temporary Total Disability rate.
Death Benefits These
benefits are availble to the spouse and minor children of an employee
who died as a result of an on the job injury. This benefit is
calculated at the rate of two-thirds of the deceased worker's average
weekly wage at the time of the accident, up to a maximum of $500.
Funeral expenses are covered by the workers comp policy up to $7, 500.
Workers comp will pay a widowed spouse with no children up to a max of
$150,000 in weekly payments. A dependent child of deceased worker is
eligible to receive weekly payments until he/she reaches age 18.
Medica Benefits
Rehabilitation and medical treatments are covered by workers
compensation but all non-emergency care must be provided by doctors
approved on the employer's panel of approved physicians.
